Abstract: The study covers the main aspects of herbal medicines patents and inserting a meta-analytic methodology to analysis herbal medicines patents and to construction of a manual of good practice in the drafting of herbal medicines patents. Requests of herbal medicines patents were analyzed interest to SUS contained in RENISUS list. For the construction of the manual of good practice in writing in phytomedications, the study evaluated by meta-analysis patent applications of native medicinal plants of Brazil contained in Medicinal Plants ratio of interest to SUS - RENISUS. In the screening process, we found 72 requests for phyto patent containing the species of Brazilian native plants, in which we analyze, from the creation of a checklist, the content contained in the applications with critical analysis and scientific and technological prospection
product generated with the meta-analysis tool applications. We emphasize the results the main mistakes in drafting patents, also highlight the guidelines of technological foresight when analyzing patents and in the appendix, we developed the manual of good practice in drafting patents in phytomedications.
